1. Agreement to Terms
By accessing or using the Algodón application and website at algodon.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Algodón is a digital wardrobe management platform that allows users to catalogue clothing items, plan outfits, receive AI-powered style suggestions, and track wardrobe analytics. The Service is available via web application and mobile applications (iOS and Android).
3. Eligibility
You must be at least 16 years of age to use the Service. By using Algodón, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
4. Account Registration
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription Plans & Billing
Free Plan (Essentials)
- Limited to 50 wardrobe items.
- Basic outfit builder and 3 daily outfit suggestions.
- Subject to feature limitations as described in the app.
Paid Plans (Closet Pro, Atelier)
- Billed monthly or annually via the App Store, Google Play, or direct payment.
- Annual plans receive a discount as advertised at the time of purchase.
- Prices are listed in GBP and may vary by region.
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
Cancellation & Refunds
- You may cancel your subscription at any time through your app store account settings or within the Algodón app.
- Cancellation takes effect at the end of the current billing period; no partial refunds are provided.
- Refund requests for app store purchases should be directed to Apple or Google as applicable.
6. User Content
Your Content
- You retain ownership of all photos and data you upload to Algodón ("User Content").
- By uploading User Content, you grant us a limited, non-exclusive licence to process, store, and display your content within the Service for the purpose of providing and improving the Service.
- You may delete your User Content at any time; see our Privacy Policy for retention details.
Content Standards
You agree not to upload content that:
- Infringes on third-party intellectual property rights.
- Contains illegal, harmful, or offensive material.
- Includes malicious code or attempts to interfere with the Service.
7. AI Features
- Algodón uses artificial intelligence to auto-tag clothing items, suggest outfits, and provide wardrobe analytics.
- AI suggestions are provided for informational and entertainment purposes. We do not guarantee the accuracy, suitability, or fashion appropriateness of AI-generated recommendations.
- Anonymised, aggregated wardrobe data may be used to train and improve our AI models. Individual photos are not used for training without explicit consent.
8. Intellectual Property
- The Algodón name, logo, brand assets, app design, and underlying technology are owned by Algodón and protected by intellectual property laws.
- You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
9. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Attempt to gain unauthorised access to our systems or other users' accounts.
- Use automated tools (bots, scrapers) to access the Service.
- Interfere with or disrupt the Service or its infrastructure.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Algodón shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or damage to clothing or personal property based on outfit suggestions.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Algodón, its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via the app or email. Your continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you should discontinue use of the Service.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Termination
- You may terminate your account at any time by deleting it through the app settings.
- We may suspend or terminate your account if you violate these Terms, with or without notice.
- Upon termination, your right to use the Service ceases. Data deletion follows our Privacy Policy.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
